Ana de Armas: Judge throws out legal action over Yesterday film

Ana de Armas fans sued after she was edited out of a film despite appearing in the trailer. A US judge dismissed their lawsuit.

In the trailer for 2019’s Yesterday, Conor Woulfe and Peter Michael Rosza say they paid $3.99 (£3.16) to rent the film.

When they discovered de Armas wasn’t in the film, they accused Universal Pictures of false advertising.

They were rejected by a judge who called their actions “self-inflicted”.

Hemsh Patel, Lily James, and Ed Sheeran starred in Danny Boyle’s Beatles-themed film, which made $155 million (£122 million) worldwide.

Patel’s character appeared to flirt with de Armas’ character on a talk show in a trailer released months before the film’s release.

Curtis explained that the actress was cut because test audiences didn’t like Patel’s character straying from his primary love interest.

According to him, de Armas’ departure was “very traumatic” since he was “brilliant.”

In spite of this, Mr Woulfe and Mr Rosza claimed Universal Pictures had “deceived” them, saying they would not have rented the film if they had known de Armas wouldn’t appear.

A class action lawsuit was filed on behalf of other disappointed fans, seeking at least $5m (£3.9m) from Universal.

In the Yesterday movie trailer, Ms De Armas’s scenes were featured to promote the film because of her fame, radiance, and brilliance.

A trailer containing an actor or actress who did not appear in the film being advertised had never been seen before, according to the plaintiffs.

Mr Woulfe claimed he was deceived a second time after renting the movie on Google Play, which listed Armas as a cast member. According to Woulfe, de Armas could appear in that version if it was a director’s cut.

The court, however, found that the complainant lacked standing to sue because he “self-inflicted his injury”.

The judge also stated that there was no reason to believe that the version of Yesterday they accessed on Google Play was different from the version they saw on Amazon the first time.
